RE: The tariff classification of a skid-mounted water pump and diesel engine from Poland

Dear Mr. Robertson:

In your letter dated June 8, 2010 you requested a tariff classification ruling. Descriptive literature and illustrations were submitted.

The product you plan to import is described as a skid-mounted pump and diesel engine. This unit is intended for use on onshore and offshore oil platform installations. It is located between the oil platform water reservoir and the water delivery system and serves as the high-pressure water system needed to suppress fires. The unit is comprised of a single-stage, single-suction centrifugal type liquid pump that has a discharge outlet of 150 millimeters (15 centimeters) and a 6 cylinder, 222 HP turbocharged diesel engine mounted within a structural frame and attached to a skid.

The applicable subheading for the skid-mounted water pump and diesel engine will be 8413.70.2025, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other centrifugal pumps, single-stage, single-suction, frame-mounted, with discharge outlet 7.6 centimeters or over in diameter. The rate of duty is free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Kenneth T. Brock at (646) 733-3009.

Sincerely,
